1. Acceptance of Terms

By downloading, installing, or using DreamKeeper ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and Shankar Dutt, the developer of DreamKeeper ("we," "us," or "our").

2. Description of Service

DreamKeeper is a personal dream journal application that allows you to:

• Record and store dreams using text or voice
• Tag dreams with emotions, themes, and other metadata
• View analytics and insights about your dream patterns
• Look up dream symbols in our dictionary
• Use tools designed to support lucid dreaming
• Sync data across devices (Premium feature)

3. User Accounts

DreamKeeper does not require you to create an account. The App uses your device's local storage and, optionally, your Apple ID for iCloud sync.

You are responsible for:

• Maintaining the security of your device
• All activity that occurs through your use of the App
• Your Apple ID security if you enable iCloud sync

4. User Content

4.1 Your Content

You retain all ownership rights to the content you create in DreamKeeper, including:

• Dream journal entries
• Voice recordings
• Notes and tags
• Any other content you input

4.2 Content License

By using the App, you grant us a limited license to store and process your content solely to provide the App's functionality. We do not claim any ownership of your content.

4.3 Prohibited Content

While we don't monitor your content, you agree not to use DreamKeeper to store or share:

• Content that violates any law
• Content that infringes others' rights
• Malicious code or data

5. Subscriptions and Payments

5.1 Free Trial

DreamKeeper offers a 7-day free trial that gives you access to all premium features. After the trial period ends, you may choose to subscribe to continue using premium features.

5.2 Premium Subscription

After your free trial, premium features require a paid subscription. Subscription options include:

• Monthly subscription ($4.99/month)
• Annual subscription ($24.99/year - save 58%)
• Lifetime purchase ($49.99 one-time)

5.3 Billing

• All payments are processed through Apple's App Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings

5.4 Refunds

Refunds are handled by Apple according to their refund policies. We cannot process refunds directly. Contact Apple Support for refund requests.

5.5 Price Changes

We may change subscription prices at any time. Price changes will not affect current subscription periods. You will be notified of price changes before your next renewal.

6. Dream Dictionary & Interpretations

The dream dictionary and symbol interpretations provided in DreamKeeper:

• Are based on common cultural interpretations and should not be taken as fact
• Are not a substitute for professional mental health care
• Should not be used to diagnose or treat any condition
• May not be accurate or applicable to your personal situation

If you have concerns about recurring dreams or nightmares, please consult a qualified healthcare professional.

7. Lucid Dreaming Tools

DreamKeeper includes tools designed to support lucid dreaming practice, including WBTB alarms, reality check reminders, and binaural beats.

You acknowledge that:

• These tools are educational and experimental in nature
• Results vary between individuals
• We make no guarantees about achieving lucid dreams
• Disrupting sleep patterns may affect some individuals - use responsibly
• If you have a sleep disorder, consult a doctor before using WBTB techniques

8. Intellectual Property

8.1 Our Property

The App, including its design, features, code, graphics, and content (excluding your user content), is owned by DreamKeeper and protected by intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8.3 Restrictions

You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Remove any proprietary notices
• Use the App for commercial purposes
• Resell or sublicense the App

9. Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms.

10. Disclaimers

10.1 "As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Medical Advice

DreamKeeper is not a medical device and does not provide medical advice. The App is not intended to diagnose, treat, cure, or prevent any disease or health condition.

10.3 Data Loss

We are not responsible for any loss of data. We recommend regularly exporting your dream journal as a backup.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREAMKEEPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING FROM YOUR USE OF THE APP.

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless DreamKeeper and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

13. Termination

You may stop using the App at any time by deleting it from your device.

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

Upon termination, your right to use the App will immediately cease. Sections of these Terms that by their nature should survive termination will survive.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms on our website
• Updating the "Last Updated" date
• Providing in-app notification for significant changes

Your continued use of the App after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of Australia, without regard to conflict of law principles. Any disputes will be resolved in the courts of Australia.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DreamKeeper regarding the App.

16.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

16.4 Assignment

You may not assign these Terms without our written consent. We may assign our rights and obligations without restriction.
